How does the substantial relation test differ between professional conduct conflicts and equal protection gender classifications?+
In professional conduct the test asks whether two matters share the same core facts or legal issues so that confidential information would be material. In equal protection the test asks whether a gender classification actually advances an important governmental objective without relying on stereotypes. Both require a direct, non-attenuated connection but serve different doctrinal purposes.

What must a nonparent show to establish a substantial relationship under the Uniform Nonparent Custody and Visitation Act?
The nonparent must demonstrate a consistent caretaker role without expectation of compensation and a relationship that meets the statutory criteria in section 4(c). The denial of custody or visitation must also result in harm to the child. A bare emotional bond is insufficient without these elements.
