Dust and Noise From Shipyard
Olivia owns a waterfront home across a narrow inlet from Republic Port's ship-repair yard. The yard begins open-air sandblasting and welding that sends metallic dust onto Olivia's decks and furniture and produces noise that prevents sleep. Olivia sues for private nuisance. The operations invade her interest in the private use and enjoyment of her land because the dust and noise directly impair normal outdoor and nighttime residential activities.
