Written by attorneys · grounded in primary & secondary sources — see below
A doctrine extending the exclusionary rule to bar not only evidence obtained through a direct constitutional violation but also evidence later derived from exploitation of that illegality. The doctrine requires courts to determine whether derivative evidence was obtained by means sufficiently independent of the primary illegality or whether the causal connection remains unbroken. Attenuation analysis considers temporal proximity, intervening circumstances, and the flagrancy of official misconduct.

Hacked Server Logs Lead to Warrants
Federal agents hacked into Theresa Tucker's home server without a warrant and obtained IP logs showing access to a corporate cloud account. Agents used those logs as the sole basis for warrants targeting the company's records. The court suppressed both the original logs and the corporate records because the warrants rested entirely on information derived from the initial unlawful intrusion.
Voluntary Disclosure After Detention
Officers unlawfully entered Tiffany Torres's apartment and seized her laptop. Three days after her release, Torres voluntarily appeared at the station, received warnings that she was free to leave, and provided server credentials. Police used the credentials to obtain chat logs from a third-party server. The court admitted the logs because the voluntary disclosure after a period of freedom sufficiently attenuated the connection to the initial entry.

Frequently Asked
4
Does obtaining a later warrant automatically purge the taint from an earlier unlawful search?+
No. A later warrant does not automatically cure the taint. When the warrant affidavit rests solely on information obtained through the prior illegality, the resulting evidence remains derivative and subject to suppression absent an independent source or sufficient attenuation.
Supporting sources
What factors determine whether the taint has been attenuated?+
Courts examine the temporal proximity between the illegality and the discovery of the evidence, the presence of intervening circumstances, and the flagrancy of the official misconduct. A voluntary act by the defendant after a meaningful period of freedom can break the causal chain.
Supporting sources
When does an independent source allow admission of evidence despite an earlier violation?+
Evidence is admissible if it was discovered through a source wholly separate from the illegal conduct. Preexisting lawful information that could have supported a warrant on its own severs the causal connection to the illegality.
Supporting sources
Does the fruit of the poisonous tree doctrine apply only to physical home entries?+
No. The doctrine applies to any unreasonable search or seizure of persons, houses, papers, and effects, including corporate premises and digital intrusions such as warrantless tracking programs or keyword searches on email accounts.
