Silverline insisted the statement reflected the parties' understanding of clear title. When the seller refused to sign the revised statement the buyer sued claiming the document created an enforceable duty to clear the encumbrance.

One year later a creditor whose claim had never been presented attempted to reopen the estate. The court held the representative's appointment had terminated because no proceedings were pending.
If no proceedings involving the personal representative are pending in the court one year after the closing statement is filed the appointment of the personal representative terminates. The same rule appears in multiple probate code sections governing both formal and informal closing statements.

No. The statement must show that the estate has been fully administered by payment or settlement of all claims. A verified closing statement that fails to address an outstanding creditor claim or to send copies to unpaid claimants does not close the estate.
