Ronald Reed, a personal-injury lawyer, signs a written understanding with Riverside Healthcare. The clinic lists Reed among three malpractice attorneys it may mention to injured patients, and Reed may send imaging work to the clinic or to any other provider. Reed tells each client about the understanding at the first meeting. Because the pact imposes no exclusivity and clients receive disclosure, the arrangement satisfies the rule.
Exclusive Cross-Referral Deal
Rosa Ruiz, a securities lawyer, promises an investment firm that she will send every subpoenaed client only to that firm. The firm promises to send every legal matter only to Ruiz. No client learns of the standing deal. The exclusivity and nondisclosure render the arrangement improper.
