A doctrine in land-use law protecting a preexisting use of property that was lawful when begun but that violates a subsequently enacted zoning ordinance. The owner holds a vested right to continue the use unless it is abandoned, discontinued for the statutory period, or phased out under a valid amortization ordinance. Protection of settled property expectations limits a municipality's power to eliminate the use immediately upon rezoning.

Recycling Yard Continues After Rezoning
Riverbend Recycling LLC operated a construction debris and green waste facility for twenty years under zoning that permitted the activity. After the county rezoned the riverbank area as an environmental conservation district, it ordered the facility to close within six months. Riverbend sued to block the order. The court enjoined the shutdown because the long-standing operation qualified as a protected nonconforming use that the county could not eliminate immediately.
Amortization Ordinance Phases Out Tower
Swift Wireless maintained a cellular tower erected in 1995 under agricultural zoning. After the city rezoned the hillside residential and later adopted a fifteen-year amortization period for nonconforming towers, Swift sued to prevent removal. The court upheld the ordinance because the uniform period was reasonable in light of the tower's useful life and the owner's opportunity to recover its investment.
Eminent Domain Targets Nonconforming Parcel
Nadia Novak owned a parcel used for light manufacturing that became nonconforming after the city rezoned the block residential. When the city later pursued eminent domain for a public project, Novak challenged the taking on the ground that her vested use could not be extinguished without compensation. The court rejected the challenge because the nonconforming use doctrine protects continuation against zoning changes but does not bar a valid exercise of eminent domain.

Adult Entertainment Use Barred by Zoning
Nightingale Healthcare operated an adult bookstore that qualified as a nonconforming use after the borough rezoned the commercial district to exclude such businesses. The borough cited the store for violating the new ordinance. The court held that the First Amendment did not require the borough to permit expansion of the nonconforming use beyond its original scope.

Naomi Norton built a distinctive modern residence under zoning that allowed it. After the city adopted new aesthetic standards prohibiting such designs, it denied her permit to complete exterior work. The court upheld the denial because the nonconforming use doctrine protects the existing structure but does not guarantee the right to finish or expand it under later aesthetic rules.

Landmark Designation Limits Expansion
Nordic Ventures owned Grand Central Terminal, a designated landmark whose nonconforming commercial uses predated the landmark law. The city denied permission to build an office tower above the terminal. The court sustained the denial because the nonconforming use doctrine preserves the existing terminal operations but does not confer a right to intensify or alter the structure in ways forbidden by the landmark ordinance.
