Tenant Escrows Abated Rent

Because the leaks rendered part of the space unusable, Esme calculated a proportionate rent abatement and deposited only the reduced amount each month into a court-supervised escrow account rather than paying the landlord directly. The funds remained in escrow until the landlord completed repairs or the lease ended.
Corporation Escrows Shares for Services
Eclipse Manufacturing issued shares to consultant Eileen Epstein in exchange for a contract to provide future marketing services. The board placed the shares in escrow with a neutral agent and directed that distributions on the shares be credited against the purchase price. When may a tenant lawfully place rent in escrow instead of paying the landlord?+
A tenant entitled to withhold rent may place the rent in escrow after proper notice to the landlord. Only the abated portion of rent is placed in escrow when the landlord's default justifies a partial abatement. The funds stay in escrow until the default is cured or the lease terminates.
