A possessory interest in land classified as personal property rather than real property. It arises when a grantor conveys a limited right of possession for a term of years, from period to period, at will, or at sufferance without transferring seisin. The holder receives no inheritable estate and holds only a chattel real.

Lease Option Duration Dispute
Nadia Novak leased commercial space to Nimbus Cloud for ten years and granted an option to purchase the building at a fixed price. After twelve years Nimbus attempted to exercise the option. The court treated the option as appurtenant to the leasehold estate and applied landlord-tenant rules to determine whether the option remained enforceable.
Leasehold Interest Classification
Nina Nielsen conveyed a building to Northern Manufacturing under a written agreement that granted exclusive possession for a fixed five-year term in exchange for monthly rent. When a dispute arose over termination rights, the court identified Northern's interest as a nonfreehold estate subject to landlord-tenant rules rather than a freehold estate carrying seisin.
How does a nonfreehold estate differ from a freehold estate?+
A nonfreehold estate is personal property that carries no seisin and is not inheritable. A freehold estate is real property that carries seisin and passes to heirs. The distinction determines which writs and remedies historically protected the interest.
Which estates qualify as nonfreehold estates?+
The four recognized nonfreehold estates are the estate for years, the periodic tenancy, the tenancy at will, and the tenancy at sufferance. Each arises from a lease or similar possessory arrangement that does not convey seisin.
Why does the classification of an interest as nonfreehold matter on the bar exam?+
The classification determines whether the interest is treated as personal property subject to landlord-tenant rules or as real property carrying seisin. Exam questions often test which remedies, notice requirements, and future interests attach to each category.
Can a nonfreehold estate be created without a written lease?+
Yes. Periodic tenancies and tenancies at will frequently arise from oral agreements followed by rent payment and acceptance. The statute of frauds may still require a writing for terms longer than one year, but shorter or implied arrangements can create enforceable nonfreehold estates.
