Frequently Asked
4
When is first-class mail constitutionally sufficient for notice in a large proceeding?+
Due process requires notice reasonably calculated to reach interested parties. When names and addresses are known or reasonably ascertainable, first-class mail to those individuals satisfies the standard. Publication alone is inadequate for known recipients.

Does the mailbox rule protect an acceptance sent by first-class mail when the offer specifies another method?+
No. The offeror is master of the offer and may require a particular method such as courier or overnight mail. An acceptance sent by first-class mail instead of the prescribed method is ineffective upon dispatch even if it arrives on time.

What information must accompany first-class mail notice under the Uniform Probate Code?+
The notice must include the personal representative's name and address, state that it is sent to persons who may have an interest in the estate, indicate whether bond has been filed, identify the court where estate papers are filed, and explain that the estate is being administered without court supervision but recipients may request information or petition the court.

Is first-class mail adequate notice in a short-form merger under corporate statutes?+
It can be, provided the notice reaches each shareholder. Sending first-class mail to addresses drawn from reasonably current records within the statutory ten-day period satisfies the duty. Failure to update obviously stale addresses or use follow-up methods may render the notice defective.
